Terms and Conditions for the Hire of Birth Pool and Related Equipment

These terms and conditions govern the hire of the birth pool and related equipment ("Equipment") from Geelong Born ("we", "us", "our"). By hiring the Equipment, you ("hirer", "you", "your") agree to the following terms:

1. Use of Equipment:
   • The Equipment is intended for use solely as a birth pool and related purposes.
   • You agree to use the Equipment responsibly and in accordance with any provided instructions and guidelines.
2. Liability:
   • Geelong Born shall not be liable for any damage, injury, or death resulting from use of the Equipment.
   • You acknowledge that Geelong Born is not responsible for any damage, injury, or death resulting from the Equipment's use in a room that does not structurally support the birthing pool.
3. Attendance of a Registered Midwife:
   • All water births using the Equipment must be attended by a registered midwife who has received appropriate training in water immersion and home birth.
4. Medical Consultation:
   • Pregnant women must consult their healthcare provider before using the Equipment. Persons with medical conditions such as high or low blood pressure, cardiac disease, or other conditions contraindicating water birth should not use the Equipment.
5. Disclaimer of Adverse Outcomes:
   • Geelong Born disclaims any responsibility for adverse outcomes, including death or injury, that may occur before, during, or after labour and birth, irrespective of who is present during the birth.
6. Acknowledgment of Responsibility:
   • You acknowledge that the safety of everyone involved in or near the birth pool is your responsibility. This includes birthing mothers, unborn babies, newborn babies, and others present during the birth.
7. Indemnification:
   • You agree to indemnify and hold Geelong Born harmless from any claims, losses, liabilities, damages, and expenses arising out of or related to your use of the Equipment.
8. Termination of Hire:
   • Geelong Born reserves the right to terminate the hire agreement and reclaim the Equipment if these terms and conditions are breached or if safety concerns arise.

By hiring the Equipment from Geelong Born, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
 
 
General Terms and Conditions (all products in homebirth bundle)

When you book your hire, you agree to the following Terms & Conditions:

1. Your hire is for 6 WEEKS. Delivery 36—37wks and Pick Up 42 weeks or when ready post birth.
2. Your hire includes a birthing pool, inflating pump, hose for filling water, drain pump and hose for draining water, disposable liner, Wooden acupressure combs, Affirmation cards, Elle Tens machine and pads with spare batteries, laminated birth cheat sheet, bunting for you to personalise with affirmations or visualisations.
3. The birthing pool will only be used according to the instructions provided. See QR code on side of pool for instructions. Geelong Born will not be held responsible or liable for any injury or damage sustained as a result of misusing the birthing pool.
4. Your birthing pool has been checked, cleaned and sanitised, and it will be supplied to you to the best out our ability in perfect working order.
5. The birthing pool is NOT to be used without a disposable liner.
6. Used disposable liner is to be thrown out by the customer or kept for future births or reuse for home use when possible. For example keep and dig a hole and create a backyard pond for you to use in summer as a mini pool. The kids will love it. Hose it down post birth and hand it out to dry. Perfecto. Try and be environmentally friendly.
7. Emptying of the birthing pool is only to commence once the birthing pool has been completely VACATED. The submersible pump and hose is NOT to be placed into the water until the pool has been completely vacated.
8. We recommend that you prepare your birthing pool, inflate early and even have a trial run when possible. Depending on facilities it can take 40-60min to fill.
9. No refunds will be given if you did not end up using the birthing pool. Though if for some reason you didn’t get to use it in labour or birth please feel free to have a re birth in the pool and enjoy this moment with your newborn. This can be very healing especially when birth wishes don’t go according to plan.
10. This bundle is hired on the understanding that it will only be used by the person on the booking, and not transferable between others people.
11. You can cancel anytime up until 37weeks. You will be reimbursed the full amount, less $15 administration fee.
12. It is the responsibility of the customer/hirer to check all the contents for the birthing pool hire package, upon receipt. The customer must advise Geelong Born immediately if there are any problems. Geelong Born does NOT accept responsibility where the customer fails to do so.
13. The customer/hirer would have discussed the use of a birthing pool with the medical practitioner in charge of their obstetric care, and will have received the practitioners approval to use the birthing pool for labour and birth and not get into the pool if there isn’t a medical professional available for assistance.
14. The birthing pool is within warranty for use, whereby the manufacturer warrants 40 uses.
15. The customer/hirer accepts responsibility for all risk from any use of the birthing pool.
16. Any and all damage that results from the misuse or neglect of the birthing pool and its equipment during your hire period are to be paid if full.
17. Geelong Born only supplies the customer with an Elle TENS on the understanding that it will only be used by the person whose name appears on the booking form and is not transferable between individuals.
18. Refunds for non-faulty TENS units will not be provided once the TENS unit has been dispatched. This includes a refund will not be given if the hirer does not end up using the TENS.
19. In the event of cancellation the hire fee will be refunded less an administration fee of $15.
20. Ensure the TENS will not be used anywhere near water. This included the shower and birth pool.
21. The Elle TENS is to only be used following the instructions provided. A link of the instruction manual is also found on Elle TEN's website.
22. We understand that things break, and can so unexpectedly. If your Elle TENS hire is returned to us damaged by misuse, you agree to pay for the repair or replacement costs of the machine and its accessories. If the hire product is lost or stolen, you agree to pay the full retail cost of the unit and accessories.
23. Geelong Born will not be held liable or responsible, for anything that may arise from the use or possession of the TENS. By hiring the TENS machine you agree to indemnify and not hold Geelong Born responsible / liable for anything that may arise from the use or possession of the Elle TENS machine and its parts and equipment.
